The USCIS has announced an increase of the Premium Processing fee that applies to requests for expedited adjudications of eligible applications and petitions. The premium processing service is only available for applications/petitions and categories identified as eligible on the USCIS website.

Any Form I-907, Request for Premium Processing Service, received on or after February 26, 2024, must include the new fee.

  • For Form I-129, Petition for a Nonimmigrant Worker (E-1, E-2, E-3, H-1B, L-1A, L-1B, L Blanket, O, P, and TN) and Form I-140, Immigrant Petition for Alien Worker (EB-1, EB-2 including national interest waiver, and EB-3), the fee will increase from $2,500 to $2,805. USCIS adjudicates these requests, with limited exceptions, within 15 days.
  • For Form I-539, Application to Extend/Change Nonimmigrant Status (classifications F, M, J, and dependents of E, L, H-4, O, P and R categories), the fee will increase from $1,750 to $1,965. USCIS adjudicates these requests, with limited exceptions, within 30 days.
  • For Form I-765, Application for Employment Authorization (Certain F-1 students with categories C03A, C03B, C03C – i.e., OPT, post-completion OPT, and STEM OPT), the fee will increase from $1,500 to $1,685. USCIS adjudicates these requests, with limited exceptions, within 30 days.
