Request for Expedite Processing in Select Cases

When premium processing is not available, employers can still submit a request to expedite a petition or application if they meet at least one of the expedite request criteria supported by documentary evidence. The decision to expedite a case is discretionary and will be reviewed by USCIS on a case-by-case basis. They expedite criteria are as follows:

  1. Severe financial loss to company or person; and/or
  2. Emergency situation; and/or
  3. Humanitarian reasons; and/or
  4. Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States; and/or
  5. Department of Defense or national interest situation (These particular expedite requests must come from an official U.S. government entity and state that delay will be detrimental to the government.); and/or
  6. USCIS error; and/or
  7. Compelling interest of USCIS.
